Property owned by the Green Run Homes Association, a Virginia nonprofit and non-stock corporation, whose purpose is to promote the welfare of the residents within the development, is subject to taxation. § 58-12(5), Code of Virginia, which exempts property owned by a community club or association, which property is used or operated for community purposes and not for profit, is declared unconstitutional by the office of the Attorney General.
