On Friday, August 24, 1990, six Virginia railroads filed suit against the Department of Taxation (Chesapeake Western Railway, et al. v. William H Forst, Tax Commissioner, et al.) in the United States District Court for the Eastern District of Virginia. The suit seeks an injunction barring the Department of Taxation from publishing 1990 assessments of Virginia railroad operating property performed in the manner which the Department believes is consistent with the recent Virginia Supreme Court ruling in the matter of County Board of Arlington, et al. v Virginia Department of Taxation, et al.
On Friday, August 31, 1990, the U. S. District Court placed Chesapeake Western on the Court's docket for a trial on the merits to begin September 28, 1990.
The Department of Taxation, by counsel, has agreed to delay publication of the 1990 assessments until this matter is heard by the Court. The Department anticipates that assessments will be published in time to permit the timely billing and collection of taxes due December 5, 1990. If further delays should become necessary, the Department will issue assessments as soon after the court proceeding as possible.
